Oct. 14, 2024. Reno/Sparks, Nev. – Pursuant to Nevada Revised Statutes (NRS) Chapter 445B, District Board of Health Regulations Governing Air Quality Management (DBOH Regulations), and the Clean Air Act, Northern Nevada Public Health’s Air Quality Management Division (AQMD) is issuing the following Notice of Proposed Action.
The AQMD received an application for the modification of a Synthetic Minor Air Quality Permit to Operate AAIR16-0933 from the following applicant:

Empire Mining Co., LLC (Empire) is a gypsum product manufacturer located south of Gerlach, NV. Empire operates non-metallic mineral processing equipment and gasoline dispensing equipment.
Empire Mining Co., LLC is requesting to modify their Synthetic Minor Air Quality Permit to Operate by including the emissions units from their two (2) gasoline dispensing facilities and stucco production circuit. This circuit includes hoppers, conveyors, rock tanks, mills, dryers, classifiers, screw conveyors, LP tanks, kettle calciners, hot holding tanks, elevators, a scalping screen, mixer, baggers, and baghouses.
Based on the preliminary review and the requirements of the NRS, the DBOH Regulations and the Clean Air Act, the AQMD is hereby announcing their intent to issue the proposed Authority to Construct based on a review of the information submitted. A copy of this document, the application, the draft Authority to Construct (ATC), and the Technical Support Document (TSD) will be available for public inspection at ourcleanair.com.

The application, draft ATC, TSD, and any comments received, and other relevant information may be copied at the above address or copies may be obtained by written request to the above address. Written comments or objections will be received at AQMD, above address, until November 14, 2024, and will be retained and considered prior to final action on the proposed Authority to Construct.
The AQMD will submit the proposed ATC to the U.S. Environmental Protection Agency (EPA) for a 30- day review period on the same day the 30-day public comment period commences.
