NNPH – Air Quality updating Nevada State Implementation Plan

Aug. 28, 2025. Reno/Sparks, Nev. – Northern Nevada Public Health (NNPH) – Air Quality Management Division, pursuant to Title 40 of the Code of Federal Regulations Part 51 Section 102 (40 CFR 51.102), is issuing the following notice on the proposed rescission of Environmental Protection Agency (EPA)-Approved Air District Regulations in the Nevada State Implementation Plan (SIP) for Washoe County.

AQMD is updating these outdated regulations in the State Implementation Plan so they match the current District Board of Health rules already in effect. This is mainly a housekeeping step required by EPA to close old regulatory gaps and does not change how air quality is currently managed in Washoe County.

AQMD is requesting recission of all EPA-Approved Air District Regulations under “General Provisions,” “Source Registration and Operation,” and “Emergency Episode Plan” found in the EPA- Approved Air District Regulations in the Nevada SIP. This action is to address the EPA’s conditional approval (88 FR 10044) of the Washoe County portion of the Nevada Infrastructure SIP addressing Clean Air Act Section 110(a)(2)(J) related to the public notification of National Ambient Air Quality Standards exceedances and addresses longstanding “SIP Gaps.”

SIP Gaps are discrepancies between the revision to the SIP that have been submitted to EPA for approval and the existing SIP regulations as codified in the CFR. The EPA-Approved Air District Regulations of Washoe County’s portion of the Nevada SIP do not match the current DBOH regulations. The EPA-Approved Air District Regulations have been incorporated into the Quality Assurance Project Plan and current versions of District Board of Health (DBOH) approved Chapters 020, 030, 050 or have been permanently rescinded. For the EPA to act on the current DBOH regulations, EPA must first approve this recission.

The details of this recission are found in the “Rescinding General Provisions, Source Registration and Operation, and Emergency Episode Plan of the EPA-Approved Air District Regulations in the Nevada SIP” letter addressed to the Nevada Department of Environmental Protection (NDEP) and is available in the Public Outreach portal of OurCleanAir.com.

Comments or a request for a public hearing on this action will be accepted until 5 p.m. PST, Sept. 27, 2025 and may be submitted via e-mail to AQMDPlanning@nnph.org or mailed or dropped off to the AQMD office at 1001 E. 9th St., Building B, Reno, NV, 89512. All correspondence must include first and last name, mailing address, and contact information for them to be retained and considered. The letter and all comments received will be sent to NDEP to formally submit to the EPA.

Upon receipt of a valid written request, AQMD will hold a public hearing during the District Board of Health meeting on Oct. 23, 2025, at 1 p.m. PST located in the Commission Chambers, Building A of the Washoe County Administration Complex at 1001 E. 9th St., Building A, Reno, NV 89512. Oral comments will be received at the public hearing.

If no request for a public hearing is received by 5 p.m. PST, Sept. 27, 2025, the public hearing will be cancelled.
