July 29, 2026. Reno/Sparks, Nev. – The Northern Nevada Public Health (NNPH) Air Quality Management Division (AQMD) is accepting public comments, business impact statement (BIS) surveys, and requests for public hearing for the proposed revisions to the District Board of Health (DBOH) Regulations Governing Air Quality Management Prohibited Emissions – Section 040.030 – Dust Control. Comments and BIS surveys received during this period will aid the development of the BIS for the proposed rule.
Comments, survey responses, and requests for public hearing will be accepted until 11:59 PM on August 28, 2026. All comments must include first and last name, mailing address, and contact information. Your comments can be submitted in the following ways:
- Email to AQMDPlanning@nnph.org.
- Mailed or dropped off to the AQMD office at 1001 E. 9th, Reno, NV 89512
The proposed revisions and BIS survey are currently available on the AQMD website, OurCleanAir.com, on the “Public Outreach” page. The BIS Survey can be found here.
A tentative public hearing is scheduled for the Oct. 22, 2026 District Board of Health Meeting taking place at 1 PM in the Washoe County Chambers located in Building A at 1001 E. 9th St., Reno, NV 89512. If no requests for public hearing are received, the public hearing will be cancelled. AQMD will notify the public of any changes or cancellation via email and on OurCleanAir.com. The public may also call (775)784-7200 to find out if it has been cancelled.
A public workshop will be hosted by AQMD on Aug. 18, 2026 from 3-4 p.m., and will include a presentation regarding the revisions made and an opportunity for questions. The public workshop will be hybrid via Microsoft Teams and can be attended in-person in the NNPH Conference Rooms A & B located in Building B at 1001 E. 9th St., Reno, NV 89512.

The Chapter 040 revisions were initiated to clarify administrative requirements of Dust Control permits and clarify requirements of Dust Control permittees. Dust Control Standards have also been revised to clarify requirements for all engaging in dust-generating activities.
